23 Remand went from 2012 to May of 2015.
Chris filed his appeal sometime in 2011. One of his grounds for appeal was an “ineffective assistance of counsel” claim. But evidence for the claim didn’t exist in the trial record, so Chris successfully got his case remanded to trial court for a Rule 23b Hearing. In this hearing, which was before the District Court trial judge, Royal Hansen, Chris wanted to enter evidence on three grounds:
a. Did trial counsel render deficient performance by failing to hire a voice expert?
b. Did trial counsel render deficient performance by failing to hire a DNA expert?
c. If trial counsel rendered deficient performance, did this prejudice Defendant?
The judge ultimate ruled against Chris on these three items.
