In a highly unusual move, the State Supreme Court recalled Chris’s appeal and took possession of his case. There was another case on certiorari before the Supreme Court at the time, Manuel Lujan (No. 20150840-SC, No. 20131166-CA, No. 121910892-DC). Both cases had highly suspect eyewitness identification testimonies at the center of them. In late November 2019, the State made a sea change in their analytical mechanism for testing the reliability of eyewitness identification testimony; this was the adoption of Utah Rule of Evidence 617, which replaced the Ramirez test for eyewitness identification testimony. In February 2020, the State denied Lujan’s bid for freedom.
